Essa regra, no entanto,<br>\ncomporta <strong>exce\u00e7\u00e3o que se d\u00e1 justamente naqueles casos em que se<\/strong><br>\n<strong>verifica a ocorr\u00eancia de algo inusitado<\/strong>, completamente surpreendente e<br>\nque, por conta disso, faz com que o cumprimento do contrato acabe por<br>\nn\u00e3o ser poss\u00edvel ou ent\u00e3o gere a uma das partes um sacrif\u00edcio<br>\ndesproporcional. <strong>Trata-se da denominada onerosidade excessiva.<\/strong><\/p>\n<p>Nos contratos de incorpora\u00e7\u00e3o imobili\u00e1ria e constru\u00e7\u00e3o, haver\u00e1<br>\nonerosidade excessiva quando o neg\u00f3cio jur\u00eddico n\u00e3o puder ser<br>\nconcretizado ou, podendo, venha gerar a uma das partes um sacrif\u00edcio<br>\ndesproporcional e imprevisto.<\/p>\n<p><strong>Diante da pandemia do coronav\u00edrus, provavelmente as atividades<\/strong><br>\n<strong>relacionadas com a constru\u00e7\u00e3o civil ser\u00e3o afetadas<\/strong>, gerando com isso<br>\no inevit\u00e1vel atraso da entrega das obras. Regra geral os contratos<br>\nrelacionados com a incorpora\u00e7\u00e3o imobili\u00e1ria ou constru\u00e7\u00e3o preveem<br>\num prazo para a entrega do bem a ser constru\u00eddo e, acaso tal prazo n\u00e3o<br>\nseja cumprido, \u00e9 estabelecida multa contratual.<\/p>\n<p>Em situa\u00e7\u00e3o de clara for\u00e7a maior, <strong>fica evidente que tal penalidade<\/strong><br>\n<strong>deixa de fazer sentido<\/strong>, devendo ser repactuado o prazo de entrega<br>\nlevando em considera\u00e7\u00e3o novos prazos que levem em considera\u00e7\u00e3o o<br>\nper\u00edodo de interrup\u00e7\u00e3o a que a pandemia obrigou fosse praticado.<\/p>\n<p>Autor: <strong>Marcelo M.
